US Court Mandates Freedom of Abrego Garcia from Immigration Detention
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks lawful basis.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.
The situation stems from a erroneous removal to El Salvador earlier this year, which US authorities later acknowledged was an error. Following his return to the United States to face alien smuggling charges, he was held in federal custody.
In her decision, the judge pointed out that the authorities lacks a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."

The court proceedings involve conflicting claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.
He has also pleaded not guilty to the conspiracy counts, which are part of a separate trial in Tennessee.

The judge, who was overseeing his petition to removal in a Maryland district court, ruled that he must now adhere to the terms of his bond from jail in Tennessee. This order shifts his supervision to the Tennessee court.
