ICE Delivers Alert on Federal Felony Prosecution for Violence on Officers

US Immigration and Customs Enforcement announced on this week that anyone who attacks its officers will encounter serious criminal prosecution. The agency stressed that this affects all individuals, irrespective of their legal standing.

Broad Language Sparks Questions Over Protest Activities

The warning could potentially allow prosecutors to pursue assault charges for actions that might otherwise be categorized as resisting arrest or peaceful protest. Embedded within the official post was an image with the phrase “think before you resist” featuring a clenched fist.

Department of Homeland Security Broadens Definition of Threats

Kristi Noem has stated that “violence” encompasses filming ICE activities and revealing personal information of agents. This expanded view has recently led to the detention of reporters, such as a Georgia-based reporter, who was detained for filming an enforcement action.

“Anything that threatens [DHS agents] and their security is considered violence.”

Reports of Increased Incidents Met With Skepticism

The Department of Homeland Security claimed that attacks on ICE officers had increased 1,000%, though when requested specific examples, officials referenced events such as garbage placed on an officer's property and insulting posters. Notably, the Federal Bureau of Investigation offered a bounty of $50,000 for information leading to the arrest of an person who was seen shooting a gun during a West Coast raid.

Ongoing Judicial Developments Enable Expanded Operations

A Supreme Court ruling has removed legal barriers that previously curtailed ICE power in the state, leading DHS to vow it would “increase presence” in LA. At the same time, fatal incidents during operations have persisted, including a recent shooting in Illinois.

Federal prosecutors have also brought assault charges against several demonstrators this year, with some cases involving actions that typically fall under resisting arrest.
